Terms of Service

These Terms of Service ("ToS") govern access to and use of the Meikai software platform and related services (the "Service"), provided by MEIKAI LTD ("Meikai", "we", "our", or "us").

By creating an account, accessing, or using the Service, you agree to be bound by these ToS. If you do not agree, you must not use the Service.

Browsing the public marketing site at https://www.meikai.ai is also described in our Privacy Policy and Cookie Policy.

For customers that have signed or accepted an Order Form, subscription agreement, partner agreement, or Data Processing Addendum ("DPA") with Meikai, the applicable written terms (including our Standard Terms and Conditions where referenced) govern to the extent of any conflict with these ToS.

Meikai provides a software-as-a-service (SaaS) platform enabling organisations to analyse, monitor, and interpret brand visibility, perception, and representation within AI-generated content and large language models (LLMs). The Service is provided for professional and business purposes only.

To access the Service, you must create an account. You agree to:

• Ensure that all users under your account comply with these ToS
• Keep your account credentials secure and confidential
• Provide accurate, current, and complete information
• Notify Meikai promptly of any unauthorised access or security incident affecting your account

You are fully responsible for all activity occurring under your account.

Access to features may vary depending on subscription plan, user role, and permissions. Meikai reserves the right to modify, add, or remove features or access levels in line with product development and contractual commitments.

You may use the Service solely for internal business analysis, brand monitoring, and strategic insights, unless a written agreement with Meikai expressly permits otherwise (for example authorised reseller, white-label, or partner programmes). You shall not:

• Extract or scrape data at scale outside documented usage or API limits
• Use the Service to develop or train competing products without Meikai's prior written consent
• Resell, sublicense, or make the Service available to third parties except as permitted in writing
• Remove or obscure proprietary notices, or misrepresent outputs as human-verified facts where they are model-generated
• Use the Service in violation of applicable laws, third-party rights, or export controls

The Service relies on automated systems and third-party AI models. You acknowledge that outputs are probabilistic, context-dependent, and may vary over time. Meikai does not guarantee accuracy, completeness, consistency, or fitness for a particular decision.

Outputs are informational and indicative only. They do not constitute legal, financial, regulatory, or strategic advice.

The Service may incorporate or reference data, content, or services from third parties (including AI providers, analytics tools, and data partners). Meikai does not warrant third-party availability, accuracy, or licensing terms. You are responsible for ensuring your use of outputs complies with applicable third-party and industry restrictions.

Where the Service or related deliverables include benchmarks, indexes, rankings, or aggregated statistics, these are provided for internal business use unless a written agreement expressly grants broader publication or distribution rights.

You shall not publish, redistribute, or commercialise such materials in a manner that suggests endorsement by Meikai or any third party without prior written approval.

Meikai does not guarantee uninterrupted access. Maintenance, updates, or temporary suspensions may occur for technical, security, or operational reasons.

Certain features require paid subscriptions. Subscriptions are billed in advance and are non-refundable unless otherwise stated in your Order Form or applicable law.

You retain ownership of all data submitted to the Service ("Customer Data"). You grant Meikai the right to host, process, and analyse Customer Data to provide the Service, support security and operations, and generate aggregated or anonymised statistics that do not identify you or your end users.

Personal data is processed as described in our Privacy Policy. Enterprise customers may execute Meikai's Data Processing Addendum on request (see Legal centre).

Each party agrees to keep confidential any non-public information disclosed in connection with the Service, except as required by law or with the disclosing party's consent.

Meikai may suspend or terminate access in case of breach, misuse, non-payment, or material security risk. You may stop using the Service at any time; accrued fees and surviving clauses apply as stated in your subscription or Order Form.

All intellectual property rights in the Service, documentation, and Meikai branding remain the exclusive property of Meikai or its licensors. No rights are granted except as expressly set out in these ToS or a signed agreement.

You shall not use Meikai's name, logos, or trademarks in public materials without prior written consent, except for factual references required by law or already approved in writing.

Meikai may identify you as a customer (including name and logo) only with your prior approval or as permitted in a signed agreement.

Meikai shall not be liable for indirect or consequential damages. Subject to applicable law, each party's aggregate liability under these ToS shall not exceed two (2) times the fees paid in the twelve (12) months preceding the event giving rise to the claim.

This limitation does not apply to fraud or wilful misconduct, or to the extent liability cannot be limited under applicable law.

You agree to indemnify Meikai against claims arising from your use of the Service, Customer Data, or violation of these ToS, except to the extent caused by Meikai's breach or negligence.

Meikai may modify the Service or these ToS from time to time. Material changes will be reflected by an updated "Last updated" date. Continued use after the effective date constitutes acceptance, unless your signed agreement requires otherwise.

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer or employment protections require otherwise.
